BLACKFOLIUM di Di Leonardo Andrea, with legal headquarters in Civitella del Tronto (TE), Via Tavolaccio 5, and VAT: IT01843210673 / Fiscal Code: DLNNDR88R01E058J are the owners of the webSite www.blackfolium.com. These General Conditions of Sale (“Terms and Conditions”) are governed by the Consumption Code (Legislative Decree No. 206/2005), section II Contracts on a Distance (Article 50 – 67) and the rules on e-commerce (Legislative Decree 70/2003).
PREMISE:
All of our sales are governed by these general terms of sale (Terms and Conditions). The general terms and conditions of sale, without any exclusion, are considered to be accepted in full by the Customer at the time of purchase of the goods via www.blackfolium.com via Email and / or any other form and / or sales channel. The Customer is encouraged to print or to preserve the general terms and conditions of sale in the preferred manner. In the event of variations in the terms and conditions, the general terms and conditions published on the WebSite www.blackfolium.com will be applied upon the order being sent by the Customer.
ORDERS VIA EMAIL:
The Customer is required to send his request in writing by Email at info@blackfolium.com We suggest the utmost care and clarity in compiling the order, indicating article name, color, quantity to facilitate understanding and subsequent evasion. At the same time as the order is required, the following information must be provided: name and surname or company name, billing address or legal address, tax code or VAT number, telephone address, delivery address if different from billing address or home address. When ordering, a subsequent order confirmation will be followed. Email purchase contracts are concluded with BLACKFOLIUM di Di Leonardo Andrea.
ORDERS FROM SITE:
The products and their prices presented on the www.blackfolium.com Site constitute an offer to the public in accordance with the terms specified in the general terms of sale (Terms and Conditions) on the Site. The terms of this offer apply only to purchases made on the Site. The Customer is required to complete the personal data fields with the utmost care. The Customer successfully completes the order procedure if the WebSite does not display any error messages. The contract is to be concluded upon receipt of the order by BLACKFOLIUM. In such a case, BLACKFOLIUM will acknowledge receipt of the order by sending an order confirmation Email to the Email address communicated by the Customer. Purchase contracts entered into on the Site are concluded with BLACKFOLIUM di Di Leonardo Andrea.
PRICES:
All prices show the relevant VAT and delivery costs are highlighted at time of order. Exchange instability, increases in general costs and raw materials could lead to unpredictable price increases for our products, but the price shown on the Site will be applied at the time of order, without any consideration of any price changes intervened subsequently or previously.
PAYMENTS:
For orders from Site, payment is required to complete the order in the manner specified on the Site. At the time of the order confirmation, the amount corresponding to the purchased products will be charged to the Customer. For Email orders payment terms will be placed on the order.
TERMS OF DELIVERY:
The delivery time for orders received via Email will be agreed upon on order. The delivery time of the products displayed on the Site is 14 (fourteen) calendar days, it is our daily commitment to deliver the products ordered as soon as possible. All orders will be processed as DAP (Delivered at place) Incotrems. This term indicates that the seller is only responsible for shipping the product, and that the Extra-EU customer is responsible for paying any import costs to the shipping carrier, such as VAT, duties and clearing fees, upon delivery. BLACKFOLIUM issues invoices for the purchased products, sending it to the Customer by Email at the address provided to the order. For the issue of the invoice, the information provided by the Customer is true. No change of data will be possible after the invoice is issued. Delivery costs are the responsibility of the Customer and are adequately highlighted on the order. The goods are always and only at the Customer’s risk and danger, even if they are made free of charge. All shipments and deliveries are to be considered as “ex works” at our registered office on the Site, BLACKFOLIUM is therefore not liable under any circumstances, as provided for by law, for any theft, loss, subtraction, damage, total loss or part of the goods being transported, as our responsibility declines with the delivery of the goods to the cargo carrier. When delivering the products, the customer is required to check the number of packages as well as to check that the packaging is intact, not damaged, neither wet nor otherwise altered, even in sealing materials such as adhesive tape and / or metal strips. In the event of obvious damage to the packaging and / or the product, the Customer may refuse the delivery of the products themselves, which will be returned to BLACKFOLIUM without any charge to the Customer. Once the delivery document has been signed, Customers will not be able to object to the external features of the delivered products. Any problems regarding physical integrity, correspondence or completeness of the products received must be promptly reported to BLACKFOLIUM for the activation of warranty conditions. No liability can be charged to BLACKFOLIUM in case of transport delay. In the event of a Customer not having withdrawn the Products within the above deadline, the order will automatically be canceled and returned to BLACKFOLIUM. In this case, the shipping costs will not be refunded to the Customer.
RIGHT OF WITHDRAWAL:
If the Customer qualifies as a consumer under applicable consumer protection legislation, they have the right to withdraw from the purchase contract without providing any reason and without incurring any penalty, pursuant to Articles 52 et seq. of Legislative Decree No. 206/2005, the Consumer Code, Directive 2011/83/EU on consumer rights, as amended where applicable by Directive (EU) 2023/2673, and the relevant national implementing legislation. The withdrawal period expires 14 (fourteen) calendar days from the day on which the Customer, or a third party designated by the Customer other than the carrier, acquires physical possession of the products. To exercise the right of withdrawal, the Customer must notify BLACKFOLIUM of their decision to withdraw from the contract by means of an explicit declaration sent before the withdrawal period expires. Where applicable under applicable consumer protection legislation, for contracts concluded online, the Customer may also exercise the right of withdrawal through the dedicated online withdrawal function available on the Website. Once the withdrawal request has been submitted, BLACKFOLIUM will provide the Customer with a confirmation of receipt on a durable medium without undue delay.
However, the right of withdrawal is subject to the following conditions:
- the right applies to individual products purchased in their entirety;
- the products must be returned intact, unused, undamaged, and, where reasonably possible, in their original packaging, complete with all accessories, tags, labels, packaging, and accompanying documentation;
- the shipping costs relating to the return of the product are the responsibility of the Customer;
- return shipments are the full responsibility of the Customer until delivery to BLACKFOLIUM.
If the right of withdrawal has been properly exercised, BLACKFOLIUM will refund to the Customer the full amount already paid within 14 (fourteen) days of receipt of the notice of withdrawal. The amount reimbursed will be net of the delivery costs of the products.
GUARANTEES:
All products manufactured by BLACKFOLIUM have "Lifetime Guarantee" which provides the repair or replacement of the product for structural failure due to incorrect assembly or manufacturing. The "Lifetime Guarantee" does not cover damage caused by improper use, negligence, normal wear and tearing or break of materials over time. Here are a few examples in which our "Lifetime Guarantee" will not answer: Bullet holes; damage from explosion; knife or all kinds of cuts; abrasions; flames or heat sources; any other destructive form. Any modification or intervention on the product performed by the client shall cancel the guarantee.
TREATMENT OF PERSONAL DATA:
Customer Data is processed by BLACKFOLIUM in accordance with the provisions of the Personal Data Protection Act, as specified in the information provided in the “Privacy” section that forms an integral part of these general terms of sale.

For any controversy or dispute the competent forum is that of Teramo.
